O R D E R

This writ petition has been filed on the apprehension that the

temple tank belonging to the fifth respondent is going to be let out for fishery lease.

Today the Executive Officer has filed a memo clearly stating

that there is no such proposal. The memo reads as follows:-

“The tanks owned by the temple was refurbished at the cost of Rs.23.50 Lakhs through a donor. Now the tank is full and the water is letting into the tank through a canal from the river. The outlet has not been restored and the water is stagnated in the tank. The fishlings were let out into the tank without getting any permission from the temple administration. Anyhow the temple administration is not proposed to lease out the fishing right to anybody. If needed the fishes will be caught and sold by the temple administration during summer season. It is needless to point out a foul smell will be emanated from the tank if the fishes died without water.”

Recording the said submission, this writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed.
