PRAYER:- Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondents 1 to 6 to take immediate action to remove the encroachment of the cart track pathway which starts in S.No.811 and ends in S.No.346/2A for 136 meter, by the 7^th respondent herein as per the proceedings already made by the 4^th respondent in Oo.Mi.A2/22/2025 dated 22.07.2025 and also in Moo.Mu.A2/2003/2025 dated 08.09.2025 within the time as fixed by this Hon'ble Court.

2 . According to the petitioner, the 7^th respondent has encroached the cart track pathway in the subject property. In this regard, the petitioner has already sent representation on 22.09.2025 to take immediate action. However, no action has been taken by the respondents. Hence, the petitioner has filed this Writ Petition.

3. The learned Additional Government Pleader appearing for

the respondents 1 to 6, by referring to the proceedings of the 4^th respondent dated 07.03.2026 would submit that a notice under Section 7 of the Land Encroachment Act, 1905 has been issued against the 7^th respondent. He would further submit that the copy of the FMB sketch given by the official respondents does not indicate any such cart track.

4. Be that as it may, it is for the 7^th respondent to submit her

reply to the notice issued under Section 7 of the Land Encroachment Act, 1905. If any such reply is filed, the authorities shall consider the case of the 7^th respondent and pass orders on its own merits after giving an opportunity to the petitioner, 7^th respondent and other interested parties.

5. With the above directions, this Writ Petition is disposed of.

There shall be no order as to costs.
