Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorari calling for the records of the impugned order of recognition passed by the 1^st respondent dated 23.09.2022 and quash the same as far as 4^th to 6^th Respondents are concern which is in violation (i.e.,) within 1/2 kilometer radius from the petitioner's recognized institution.

The present writ petition has been filed by a typewriting institute challenging an order of recognition granted by the first respondent in favour of the respondents 4 to 6.

The recognition granted in favour of the respondents 4 to 6 is under challenge primarily on the ground that these 3 typewriting institutions are

located within 1/2 km from the petitioner's recognised institute. The learned Counsel appearing for the petitioner relied upon the guidelines issued by the Directorate of Technical Education in support of his contention. A perusal of the said guidelines would reveal that there is a procedure for granting recognition for starting any new type writing institutes, if the distance for the new type writing institute is within 250 metres from the existing recognised type writing institutes. However, if the new type writing institute is proposed to be located between 250 metres and 500 metres, the authorities can consider the said request depending upon the density of the population and the demand of the students.

In the present case, the respondents 4 to 6 have established their typewriting institutes in Paramakudi Town based upon the density of population and the demand of the students, and the authorities proceeded to grant recognition. In fact, even as per the averments in the affidavit, these 3 typewriting institutes are located beyond 250 metres. In such circumstances, there is no total bar for the authorities to grant recognition. Therefore, there are no merits in the writ petition. Accordingly, this writ petition stands dismissed. No costs. Consequently, connected miscellaneous petitions are also closed.
