This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the respondents to cancel the erroneous patta and UDR entries standing in the names of third parties in respect of the lands comprised in Survey Nos.386/1, 386/2 and 384/28 (Old S.No.384/1A/28), situated at Agarapatti Village, Kavinadu Melavattam, Pudukottai District, and consequently to issue a fresh patta in the names of the legal heirs of Late V.Singiri, S/o. M.S.Venkitasamy Naidu and also directing the respondents to rectify all connected revenue and land acquisition records, including those issued in connection with the Cauvery–Vaigai–Gundar Link Canal Scheme, based on the petitioner’s representation dated 07.10.2022, within a stipulated time as may be fixed by this Court.

With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself.

The grievance of the petitioner is that the subject lands were purchased by the petitioner’s father, late V.Singiri, vide a registered Sale Deeds in the years 1965 and 1966. After the purchase, he was in peaceful possession and enjoyment of the same, by paying the necessary kist and all other taxes. The revenue records stood mutated in his name and a patta was also issued in his favour. After his demise, the lands devolved upon his legal heirs, including the petitioner.

However, during the implementation of the UDR Scheme, grave and patent errors were committed by the revenue authorities, resulting in the patta and UDR entries being wrongly recorded in the name of one Samirav, who has no manner of right, title or interest over the subject lands. Therefore, the petitioner submitted a representation dated 07.10.2022 to the respondents, on receipt of which the second respondent ordered an enquiry vide proceedings dated 03.01.2023. However, no final order has been passed till date.

In the meantime, for the purpose of the Cauvery–Vaigai–Gundar

Link Canal Scheme, the Government issued a land acquisition notification under Section 19(2) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, erroneously publishing the names of the former vendors as landowners, solely relying upon the incorrect UDR entries. This has resulted in the risk of illegal disbursement of compensation to ineligible persons. Therefore, the petitioner has been constrained to file the present Writ Petition.

The learned Special Government Pleader appearing for the first to third respondents, on instructions, would submit that the petitioner's representation dated 07.10.2022 would be considered and appropriate orders would be passed by the second respondent within a period of sixteen weeks.

Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the second respondent to consider the petitioner's representation dated 07.10.2022 and pass appropriate orders on its merits and in accordance with law within a period of sixteen weeks from the date

of receipt of a copy of this order. The representation shall be disposed of

after conducting an enquiry. The second respondent is also directed to provide a reasonable opportunity of hearing to the petitioner, the said Samirav and any other interested parties who may be affected by such decision, before passing any order. In the event of any rival claims, the parties are at liberty to pursue their remedies before the competent Civil Court. There shall be no order as to costs.
