The petitioner challenges the Proclamation of Sale and Sale Notice

dated 14.05.2026 issued by the first respondent in Execution Petition No. 117/2024-25.

2.In the said proclamation notice, bids have been invited from interested persons for the purchase of the mortgaged property belonging to the petitioner.

¶24

3.Proceedings were initiated against the petitioner under Section 90 of the Tamil Nadu Cooperative Societies Act, which culminated in an

award directing the petitioner to pay the awarded amount. As the petitioner failed to pay the said amount, the Society initiated execution

proceedings, and the impugned Proclamation of Sale Notice has been issued in the said Execution Petition.

4.The learned Counsel appearing for the petitioner submitted that the petitioner undertakes to pay the entire award amount together with accrued interest, if reasonable time is granted.

5.In view of the request made by the learned Counsel for the petitioner, the impugned Proclamation of Sale Notice issued by the second respondent shall be kept in abeyance, subject to the following conditions:

(i)The petitioner shall deposit 25% of the principal amount before the fourth respondent on or before 22.06.2026;

¶33

(ii)The petitioner shall pay 25% of the awarded amount together with accrued interest and charges, including the interest and charges payable under the first instalment, on or before 31.07.2026;

¶34

(iii)The petitioner shall pay the remaining 50% of the awarded amount together with accrued interest and charges on or before

31.08.2026;

(iv)Upon payment of the entire amount in accordance with the

above schedule, the respondents shall release the original title deeds to the petitioner;

(v) In the event of default in complying with any of the above conditions, the respondents shall be at liberty to proceed with the auction of the mortgaged property in accordance with law.

6.With the above directions, the writ petition stands disposed of.

¶43

7.There shall be no order as to costs. Consequently, the connected miscellaneous petitions are closed.
