No. FCL/318083483/24 dated 28.05.2024 and to quash the same as arbitrary and illegal, and direct the respondent to process the petitioner's re-issue of passport vide application No. MD2075615882123 on considering the representation dated 06.05.2026 provided for the reissue of the passport reflecting the correct date of birth 1977 within a stipulated time that may be fixed by this Court.

The petitioner is before this Court seeking a direction to the respondents to consider and process his application dated 06.05.2026 seeking correction of the date of birth in his passport during its period of validity.

2.The petitioner submitted an application for correction of the date of birth recorded in his passport. According to him, the passport was originally issued when he was about 18 years of age and, due to incorrect information furnished at that time, his date of birth was recorded as 24.05.1972 instead of his actual date of birth, namely 24.05.1977. After noticing the discrepancy, the petitioner submitted a representation seeking correction of the same.

3.Pursuant thereto, the respondent issued a communication dated 28.05.2024 stating that the date of birth in the passport had been entered on the basis of a tampered Transfer Certificate and called upon the petitioner to furnish an explanation.

4.The petitioner thereafter submitted a detailed explanation along with relevant supporting documents. In support of his claim that his correct date of birth is 24.05.1977, he has also produced a Birth Certificate issued under the Registration of Births and Deaths Act, 1969.

5.The Ministry of Home Affairs, Government of India, has issued guidelines prescribing the documents that may be relied upon for issuance of passports and correction of passport particulars. As per the guidelines, documents such as an Aadhaar Card, Elector’s Photo Identity Card (EPIC), Service Identity Card issued by the State or Central Government, Birth Certificate issued under the Registration of Births and Deaths Act, and other specified documents may be considered for such purpose.

6.In the light of the above facts, this Court is of the view that the respondent is bound to consider the petitioner’s request for correction of the date of birth on the basis of the documents produced by him, subject to verification and in accordance with law.

7.Accordingly, this writ petition is disposed of with a direction to the respondent to consider the petitioner’s request and pass

appropriate orders for re-issuance of the passport by correcting the date of birth from 24.05.1972 to 24.05.1977, subject to verification of the documents produced by the petitioner and subject to his satisfying all other statutory requirements.
