Prayer : Writ Petition filed under Article 226 of the Constitution of India, for issuance of a Writ of Mandamus directing the fourth and fifth respondents to conduct survey and fix four boundaries of the petitioner’s house site measuring 0.02.0 Ares in Survey No.430/14 and 0.01.0 Are in Survey No.430/15 and 0.01.5 Ares in Survey No.430/18 situated in 44 Prantani Village, Avudaiyarkovil Taluk, Pudukottai District in the light of the Circular No.Na.ka.Na5/20403/2020 (Ni.A) dated 15.03.2021 issued by the third respondent and the order passed by this Court in W.P.(MD) No. 13465 of 2020 dated 05.10.2020 based on the petitioner’s representation dated 13.05.2023.

This Writ Petition has been filed seeking issuance of a Writ of

Mandamus directing the fourth and fifth respondents to conduct a survey and fix the boundaries of the petitioner’s house site measuring 0.02.0 Ares in Survey No.430/14, 0.01.0 Are in Survey No.430/15 and 0.01.5 Ares in

Survey No.430/18, situated at Prantani Village, Avudaiyarkovil Taluk, Pudukkottai District, in terms of Circular No.Na.Ka.Na5/20403/2020 (Ni.A) dated 15.03.2021 issued by the third respondent and the order of this Court dated 05.10.2020 made in W.P.(MD) No.13465 of 2020, based on the petitioner’s representation dated 13.05.2023.

The learned Government Advocate appearing for the first and third to fifth respondents would submit that the survey has already been conducted on 13.01.2023 and that no cause of action survives in this Writ Petition.

Recording the said submission, this Writ Petition is dismissed as

infructuous. No costs.
