This Writ Petition (Criminal) has been filed to direct the 1^st respondent to afford police protection to the petitioner to enter his property situate in Survey No.137/2B1, 237/2B1B8 and 137/2B, Velakkalnatham, Natrampalli TK, Thirupathur District and to protect him from the atrocities of the 2^nd respondent, who is obstructing the development of office proposed to be constructed by the petitioner.

Heard the learned counsel for the petitioner and the learned

Counsel for Government of Tamil Nadu (Crl. Side) appearing for the 1^st respondent. Perused the materials available on record.

The petitioner obtained decree in O.S.No.224 of 1996. As per the final decree, he was given possession of the subject property in the execution proceedings. Even then the 2^nd respondent is objecting the petitioner’s peaceful possession and enjoyment of the subject property. Therefore, the petitioner lodged a complaint, seeking adequate police protection with the 1^st respondent.

The learned Counsel for Government of Tamil Nadu (Crl. Side) appearing for the 1^st respondent submits that on receipt of the complaint given by the petitioner, an enquiry was conducted and the same was closed.

On perusal of records revealed that the petitioner has obtained decree and possession of the subject property was also handed over in favour of the petitioner.

In view of the above, the 1^st respondent is directed to take appropriate action as against the 2^nd respondent, if he disturbs the petitioner peaceful possession and enjoyment of the subject property.
