Alagesan (Prisoner No.11496 / PID No.709877, Central Prison-I, Puzhal; convicted under Section 138 of the Negotiable Instruments Act; sentences running in STC.Nos.114-118 of 2016), challenged proceedings No.C.P.PU1/301/2026-R2 dated 23.01.2026 of the Superintendent of Prison rejecting the detenu's representation dated 20.01.2026 for 10 days' ordinary/emergency leave (10.02.2026-20.02.2026, without escort) to officiate as Convenor of the Mahashivarathiri Festival at his ancestral temple, Perunkaranai Village. Held: (i) the request for 10 days' emergency leave for temple worship does not fall within the ambit of the Tamil Nadu Suspension of Sentence Rules; (ii) the second respondent rightly rejected the request in consonance with the said Rules; (iii) the impugned order is free from perversity, illegality or infirmity warranting interference. Context (per the Additional Public Prosecutor, on instructions): under Rules 6 and 13 of the said Rules, emergency leave requires a Government Doctor's medical certificate that a blood relative is critically ill, is processed on the Probation Officer's report, and is grantable in spells of 6+3+3+3 days (total 15 days), with no provision enabling 10 days' leave for temple worship.
