ORDER

The present Writ Petition has been filed seeking a direction to the 1^st respondent to consider the representation and objections dated 18.02.2026 and to initiate appropriate action in accordance with law.

Mr.S.Rajesh, learned Government Advocate takes notice on behalf of the respondents 1 to 3. Since, no adverse order is being passed against the 4^th respondent, notice to the 4^th respondent is dispensed with.

It is the case of the petitioner that he had pledged 20 sovereigns of gold jewels with the 4^th respondent on 23.12.2021 to meet the urgent educational expenses of his grand son. Subsequently, the petitioner had vacated the tenanted premises and is presently residing at ECR along with his sons. Though the change of address was intimated to the 4^th respondent, the 4^th respondent, without taking the same into consideration, proceeded to sell the pledged jewels by way of public auction. Aggrieved by the said action, the petitioner submitted a representation dated 18.02.2026 to the respondent officials seeking necessary action against the 4^th respondent which did not evoke any response and therefore, in order to espouse the said cause, the petitioner has come up with the present Writ Petition.

Though very many grounds have been raised, learned counsel appearing

for the petitioner submitted that it would suffice, if this Court issues a direction to the respondent authorities to consider the petitioner’s representation dated 18.02.2026 on its own merits and pass appropriate orders on the same.

A perusal of the entire papers on record reveals that, though the petitioner claims that he had pledged 20 sovereigns of gold jewels with the 4^th respondent, no proof has been placed before the Court so as to substantiate the said claim except the receipt dated 17.10.2020 which also does not disclose the amount alleged to have been borrowed by the petitioner and also there is no material evidence to establish that such amount was repaid to the 4^th respondent. In the absence of any cogent material to substantiate the case of the petitioner, the relief sought for in this Writ Petition cannot be acceded to and this Writ Petition is not maintainable and liable to be dismissed. If at all the petitioner has any grievance, arising out of the contractual obligations with the 4^th respondent, the appropriate remedy lies only before the competent civil court and not under article 226 of the Constitution of India. However, it is needless to say that the petitioner is at liberty to approach the competent civil court to work out his remedy in the manner known to law.
