PRAYER:- Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of Mandamus directing the respondent to pay interest at the rate of 8% per annum on the belated payment of Provident Fund, Gratuity, Surrender Leave Salary, Commuted Pension, and other retirement benefits, from the respective dates of retirement till the date of actual payment i.e., on 02.12.2025, within a time frame as may be fixed by this Court.

The Writ Petition has been filed seeking to issue a writ of Mandamus directing the respondents to pay interest to the petitioners at the rate of 8 percent per annumon the belated payment of Provident Fund, Gratuity, Surrender Leave Salary, Commuted Pension, and other retirement benefits, from the respective dates of retirement till the date of actual payment i.e., on 02.12.2025.

The case of the petitioners is that they were appointed on 07.03.1987 and 27.10.1999 under the control of Tamil Nadu State Transport Corporation (Villupuram) Limited and retired from service holding the posts of Senior 2/5

W.P.No.9182 of 2026 Tradesman and Special Grade Driver respectively on attaining the age of superannuation on 31.05.2024 and 30.06.2024 respectively. However, the terminal benefits have been settled to the petitioners only on 02.12.2025 and no interest has been paid for the delayed period. Therefore, the petitioners had submitted a representation to the respondents dated 03.02.2026, to pay the interest at the rate of 8% per annum for the delayed period. Since the same was not considered, the present writ petition has been filed.

There is no representation for the petitioners. However, the learned Standing Counsel for the respondents would fairly submit that they are willing to pay the interest at the rate of 6% per annum for the belated payment of the eligible and admissible amount.

In view of the above submission of the learned Standing Counsel, this Court deems it appropriate to direct the respondents to pay interest at the rate of 6% per annum for the belated payment of admissible terminal benefits from the date of retirement till the date of actual disbursal of the terminal benefits of the petitioners within a period of six weeks from the date of receipt of a copy of this order.
