The Writ Petition is filed alleging that the water canal in S.No.1782 has been unauthorizedly encroached upon by the second respondent.

The learned Government Advocate states that, as per Survey Report,

the canal does not run through S.No.1782. The said S.No.1782 has been classified as private land and patta has been assigned to various individuals.

The learned counsel appearing for the petitioner states that there was an error in mentioning the survey number. However, the Town Survey Register would clearly show that the canal runs through S.No.1783 and not Survey No.1782.
