The present writ petition is filed challenging the impugned order No.19/2025 dated 06.11.2025 whereby petitioner's Customs Broker License under Regulation 17(1) of CBLR, 2018, was suspended allegedly on the basis of a confidential report dated 10.10.2025. Thereafter, a continuation of suspension

order was issued on 06.11.2025 that was followed by another notice under Section 17 of CBLR, 2018, dated 29.12.2025 in Show Cause Notice No.56 of 2025.

The show cause notice dated 29.12.2025 was the subject matter of challenge in a writ petition filed before this Court in W.P.No.3405 of 2026 a, which came to be disposed of vide order dated 04.02.2026. It may be relevant to note that one of the grounds of challenge in the aforesaid writ petition was that the show cause notice came to be passed without furnishing to the petitioner copies of supporting documents relied upon by the respondent including the confidential report. The above writ petition came to be disposed with the following directions:

“7. The petitioner can make a request to the respondent through an interim reply calling for the respondent to furnish copies of all the supporting documents, relied upon by them for the purpose of revoking the petitioner’s licence and once such a request is made, necessarily, the respondent shall furnish a copy of the same to the petitioner without fail, so as to enable the petitioner to send a detailed reply objecting to the contents of the impugned show cause notice containing allegations against the petitioner for the alleged violations committed by the petitioner under the Customs Act and the CBLR regulations. The respondent will have to consider all the objections raised by the petitioner in their reply submitted to the impugned show cause notice and only thereafter, after giving due consideration to those objections, shall pass final

orders, on merits and in accordance with law by adhering to the principles of natural justice and after affording adequate personal hearings to the petitioner.”

It is submitted by the learned counsel for respondent that the proceedings under Regulation 17 of CBLR, 2018, is being adjudicated upon and there is also stay of order of suspension of the license.

In that view of the matter, this Court is inclined to dispose of the present writ petition whereby the interim order against the impugned proceedings will continue and it is open to the authorities to reconsider the same subject to the outcome in the proceeding under Regulation 17 of CBLR, 2018.

In view thereof, the status quo shall be maintained until the adjudication under Regulation 17 of CBLR, 2018 and the writ petition stands disposed of with the above observations. No costs. Consequently, the connected miscellaneous petitions are closed.
