Writ of Certiorarified mandamus calling for records of the respondent in his proceedings in respect of the Refusal Slip in Refusal Number-RFL/ Kunnathur/22/2025 dated 29.10.2025 and quash the same as arbitrary and illegal and consequentially direct the respondent to entertain and register the sale deed presented by the petitioners in respect of property being residential plots totally measuring an extent of 29,371 sq.ft bearing Plots Nos.3 to 15 situated in the Layout known as V.S.Gardern comprised in Old Survey No.161/2 New Survey No. 161/2A2 of Vattlappathi Village, Uthukuli Taluk, Tirupur District.

ORDER

The first petitioner had executed a sale deed dated 29.10.2025 in favour of the second petitioner. The said sale deed was presented for registration before the respondent herein. The request for registration was declined under the impugned refusal check slip.

Learned counsel for the petitioner invited my attention to the impugned order and contended that the refusal is on the basis of a letter dated 14.06.2017 from the Tahsildar, Uthukuli stating that a conditional patta was issued in respect of the relevant property. He submits that the Sub Registrar failed to take into consideration the order passed by the Sub Collector, Tiruppur on 13.12.2023 converting the conditional patta into an ayan patta. He also points out that genuineness and authenticity of the order dated 13.12.2023 was confirmed by the communication dated 16.12.2024 from the Revenue Divisional Officer.

Learned Special Government Pleader accepts notice for the sole respondent. For the non-consideration of the order dated 13.12.2023, he submits that the matter may be directed to be reconsidered.

On perusal of the order dated 13.12.2023, it is found that the Sub Collector, Tiruppur concluded that ayan patta be issued in respect of land in

S.No.161/2A by removing the conditions attached to the grant of patta. The impugned order has been issued without taking into consideration the said order and the genuineness certificate dated 16.12.2024 in respect thereof. Consequently, the impugned order cannot be sustained and is set aside. The petitioners are permitted to re-present the sale deed for registration. Subject to fulfilment of other requirements in relation to registration such as payment of stamp duty and registration fees, the registration shall be effected within two weeks from the date of re-presentation. The writ petition is ordered accordingly. No costs. The connected miscellaneous petition is closed.
