ORDER

The petitioners assert that they are the absolute owners of the property measuring 5428 sq.ft. situated at Survey No.811/1D in Noombal Village, Ambattur Taluk. After noticing that the encumbrance certificate contains an entry relating to caveat petition No.17 of 2024 on the file of Subordinate Court, Poonamallee, the petitioners submitted a representation for the removal thereof. Because no action was taken pursuant to said representation, the present writ petition has been filed.

Learned counsel for the petitioners refers to a similar caveat entry being made earlier and the order dated 01.08.2023 in W.P. No.22356 of 2023 to remove such entry.

Mr.U.Baranidharan, learned Special Government Pleader, accepts notice for both the respondents. He submits that neutralising entry would be made within two weeks from the date of receipt of a copy of this order.

It appears that an entry has been made in Book 1 with regard to the lodging of the caveat. Making of such entry is clearly not in consonance with the Registration Act, 1908. Therefore, the

W.P.No.49470 of 2025 respondents shall make a neutralising entry nullifying the effect of

the caveat entry. By directing the respondents to do so within two weeks from the date of receipt of a copy of this order, this writ petition stands disposed of. There shall be no order as to costs.
