Writ of Mandamus has been instituted seeking a direction to the respondents to consider de-reservation of Plot, reserved for Children Play Space in the Layout sanctioned vide LPA(CN)No.52/ 1981 situated at Vadavalli Village, V.N.R.Nagar, West Zone, Coimbatore Corporation, comprised in Survey No.71/1A19, 1B11, 1A11, 1B1M, considering the alternative availability of Children Play Space in the layout and long possession and presence of the temple and the public sentiments in view of the petitioners Representation dated 28/06/2025.

It is brought to the notice of this Court that already the Division Bench of this Court, based on the order dated 05.12.2024 in W.P.No.36854 of 2024, directed the occupants of the children play area to vacate the same by the Corporation for utilising the land as children play area, as per the approved lay out on or before 17.01.2025. The said order reads as under:

“After the petition was heard for some time, Ms.Ashok stated

that, since the temple in its present state has been in existence for the past at least 28 years and as public sentiments are involved, the court should given at least two months time to remove of idols,

etc., from the temple and for making alternate arrangements.

2. Shri K.Prabakar, appearing for the Corporation, leaves it

to the court and states that the court may give a reasonable.

¶36

3. We give time upto 17.1.2025 for petitioners as well as their well-wishers to remove the idols, etc., from the temple.

4. We clarify, we have not gone into the issue as to whether

the temple will fall within the definition of ‘public purpose’.

The present writ petition has been instituted seeking the relief to dereserve the plot which is not entertainable.

The negative prayer sought for, to de-reserve the children play area earmarked in the lay out, cannot be granted, since it would be in violation of the provisions of the Tamilnadu Town and Country Planning Act as well as the judgment of the Hon’ble Supreme Court of India.

The land earmarked for children play area should be utilised for the purpose, for which, it is earmarked. Therefore, the official respondents, Coimbatore Corporation, is directed to initiate enforcement action and remove the encroachments and resume the children play area and develop children park for the benefit of the children in that locality.

The petitioner, having undertaken to vacate the children play area in

the earlier writ petition, based on which, an order was passed, has now turned around and filed the present writ petition, which is deprecated. Thus, the authorities are bound to initiate enforcement action and remove the encroachments and resume the children play area and utilise the same for the benefit of the children. The said exercise shall be completed within a period of twelve weeks from the date of receipt of a copy of this order.

With the above directions, the Writ Petition stands dismissed. No
