Writ of Mandamus has been instituted to direct the respondents 1 to 5 to remove the encroachment made by the sixth respondent based on the petitioner's representation dated 25.06.2025.

Learned counsel for the petitioner, relying upon the written instructions given by the Tahsildar, Arni, would submit that during the course of survey, the revenue authorities identified road encroachments and a portion of the land is under the control and maintenance of the Highways Department.

In view of the said fact, the respondents 2 and 4 are directed to initiate enforcement action in co-ordination with the Highways Authorities and ensure that road encroachments are removed by following the procedure as contemplated under relevant Statute and Rules in force. The said exercise is directed to be completed within a period of twelve (12) weeks from the date of receipt of a copy of this order.
