Prayer : Writ Petition is filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus directing the respondents herein to pay the statutory interest of 9% and 15% by passing a fresh award in accordance with Section 72 in the Central Act 30/2013, for the petitioner’s acquired land comprised in Survey Nos.198/2 (0.45.5 hectares), 198/3 (0.2.03 Hectares), 198/4 (0.17.0 hectares), 198/5 (0.16.0 hectares), 198/6 (0.23.5 hectares), 198/8A (0.14.0 hectares), 198/8B (0.27.0 hectares), 198/9 (0.36.5 hectares) in all measuring 2.02.05 hectares or 5.48 acres situated at Mambakkam Village, Sriperumbudur Taluk, Kancheepuram District by fixing the date of taking

possession in strict compliance of the Act within a time to be stipulated by this Honourable Court.

The petitioner's lands were acquired under the Tamil Nadu Acquisition of

Land for Industrial Purposes Act, 1997 and an award in respect thereof was issued on 22.10.2025. On the ground that interest for the period running from the date of taking over possession had not been paid at the prescribed rate of 9%

up to a period of one year and at 15% thereafter, the present writ petition has been filed.

Mr. P.Sathish, learned Additional Government Pleader, accepts notice

¶35

for respondents 1 to 4. He submits that the requisitioning body is the Managing Director, SIPCOT and that the Managing Director, SIPCOT should be joined as

a respondent in this writ petition because the necessary funds have to be made available by SIPCOT.

In view of the above submissions, “the Managing Director, SIPCOT,

¶41

No.19/A, Rukmani Lakshmipathy road, Egmore, Chennai-600 008” is joined as the fifth respondent herein.

Mr.Abishek Murthy, learned Government Advocate, accepts notice on behalf of the newly impleaded fifth respondent.

The documents on record disclose that possession was taken on 13.06.2017. Even the revenue records appear to have been mutated thereafter. Therefore, the petitioner has made out a case for the consideration of the request for interest in accordance with statute.

For reasons aforesaid, this writ petition is disposed of on the following

terms:

(i) The petitioner is directed to submit all necessary documents in support of the claim for interest before the third respondent within two weeks from the date of receipt of a copy of this order.

¶47

(ii) Within two months from the date of receipt of a copy of this order, the third respondent shall issue a supplementary award in relation to interest.

¶48

(iii) The fifth respondent shall make necessary funds available in respect

thereof sufficiently in advance to enable the supplementary award to be issued

within the time limit fixed.

There will be no order as to costs.
