ORDER

This writ petition has been filed to direct the 1^st & 2^nd respondent to cancel the registration of the 4^th respondent and to issue an order to refund the misappropriated funds collected in the name of Advance Maintenance Charges for two years to the tune of approximately Rs.1.50 crores to the 5^th respondent (Aurum Villa Owners Association (AVOA) during the period from July 2018 to Dec 2020 subject to the audit report.

2. When this matter was taken up for hearing, the learned counsel for the petitioner would submit that though he had sought for larger relief in this petition, he had restricted his relief to the extent to request this Court to direct the 2 nd respondent to dispose of the representation dated 08.07.2021 filed by the petitioner. Hence, he requests this Court to pass appropriate orders.

3. In reply, the learned counsel appearing for the respondent would submit that the petitioner's representation will be disposed of within time limit fixed by this Court.

4. Heard the learned counsel for the petitioner and the respondent and

also perused the materials available on record.

In the case on hand, it was submitted by the learned counsel for the petitioner that now the petitioner has restricted his relief and requested this Court to issue a direction to the respondents to dispose of the petitioner's representation, since it will be sufficient to meet out the case of the petitioner.

6. In view of the above, since the representation was made as early as in the year 2021, the petitioner is directed to file a fresh representation before the respondents. In such case, the 2 nd respondent is directed to consider and dispose of the same, on merits and in accordance with law, within a period of 8 weeks from the date of receipt of said representation.

7. With the above directions, this writ petition is disposed of. No cost.

Consequently, the connected miscellaneous petitions are also closed.
