The present writ petition has been filed, to forbear respondents, their officers, servants, agents, contractors or any person claiming through them from entering upon, excavating, trenching or laying pipeline through petitioner’s land comprised in Survey No.100/1C, situated at Thoramangalam Village, Mettur Taluk, Salem District, except by following mandatory procedure prescribed under the Petroleum and Minerals Pipelines (Acquisition of right of user in land) Act, 1962 and other applicable laws, and consequently direct respondents

to consider and dispose of petitioner’s representation dated 29.06.2026, within a time frame to be fixed by this court.

At the outset, it was submitted by learned State Counsel for respondents 1 to 3 that while proceedings were initiated to acquire petitioner’s land vide proceedings dated 13.10.2021. However, the same came to be stayed by this Court in WMP No.28078 of 3033 in W.P.No.28787 of 2022 dated

01.11.2022. It is however clarified that no excavation, trenching or any underground work is being presently carried on in petitioner’s property and would also assure that any activity would be carried out only after either acquiring the land under the Land Acquisition Act or in terms of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962, which was agreed to by learned counsel for petitioner.

Recording the same, writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed.
