The writ petition, filed by Sri Kusuma Haranath Thunai Ex-servicemen Association (Reg. No. 304/67) through its president, prayed for a Writ of Mandamus directing the Secretary, Ministry of Defence (first respondent) to approve the list of 99 Ex-Servicemen members of the petitioner association who had been allotted plots measuring 60 x 40 (2400 sq.ft) in vacant land located between 6th Street to 11th Street and Street No. 24-A and 25th Street, General Kumaramangalam Colony, Chennai - 82, and to execute sale deeds in their favour on receipt of Rs. 4,000/- towards land cost per ground. Respondents 4 and 5 (two other associations of the same name with different presidents) had been impleaded by order dated 17/02/2010 in MP 2&3/09, and N. Sundararajan had been substituted as petitioner in place of the deceased M. Vellaichamy by order dated 23/07/2014 in MP1/13. At the hearing of the main petition, the learned counsel for the petitioner submitted that the writ petition be dismissed as withdrawn and made an endorsement to that effect in the affidavit filed in support of the petition. Recording the submission and the endorsement, the Court dismissed the writ petition as withdrawn, with no costs. No question of law was adjudicated on merits.
