The writ petition is filed by the mother of N.Boomika, N.Akshaya and Kuraleswaran seeking issuance of a Writ of Mandamus directing the 2^nd respondent to issue Community Certificates to her two daughters by name N.Boomika and N.Akshaya and one son, by name N.Kuraleswaran based upon her community status and origin.

The petitioner is a native of Puducherry. According to the petitioner, her father and her ancestors were all indigenous residents of Puducherry prior to 05.03.1964. As contemplated under the Constitution (Puducherry Scheduled Castes) Order, 1964, she belongs to the Hindu Adi-Dravidar Community by origin, which is recognised as a Scheduled Castes under the said Presidential Order.

3.The petitioner submits that when she approached the second respondent seeking issuance/renewal of the Community Certificates, she was orally informed that certain issues relating to the grant of Community Certificates based on the mother’s nativity are pending consideration before the Hon’ble

Supreme Court of India. Therefore, Community Certificates cannot be issued on the basis of the mother’s nativity alone. Hence, the present Writ Petition has been filed for the aforesaid prayer.

The learned Additional Government Pleader representing Puducherry of Government submitted that the application made by the petitioner is under consideration, in the light of the Presidential Order dated 05.03.1964; the subsequent Circulars and Official Memorandums issued from time to time. Based on the Judicial Pronouncements rendered sofar, necessary decision will be taken on her application in accordance with law.
