PRAYER : Writ Petition has been filed under Article 226 of Constitution of India praying to issue a writ of declaration declaring that the oral termination of the petitioner issued by the 6th respondent herein is illegal and consequently issue directions to the 4th respondent to reinstate the petitioner into service and regularise the service of the petitioner in the post of Pump Operator in the 3rd respondent Zoo with reference to the date of initial appointment.

The writ petition is filed for the relief set out below:

It is the case of the petitioner that he was appointed as a Pump Operator on daily wage basis from 20.06.2008 in Arignar Anna Zoological Park, Vandalur, Chennai. Though he was working for more than 16 years as a daily wages in the respondent Corporation, his service was not regularized despite the representations made by him. The fifth respondent had not allowed the petitioner to perform his duty forthwith in order to create a break in service. The petitioner was orally terminated from the service without issuing any notice. Aggrieved by the same, the petitioner is before this Court.

Heard the learned counsel on either side and perused the materials available on record.

Admittedly, the petitioner is a daily wager and he has been terminated from service on account of certain allegations that he has been illegally collecting money and allowing visitors inside the Zoo without issuing any tickets. This has also been communicated to the petitioner’s management by the third respondent vide communication dated 11.03.2024, in which, they have also requested for the replacement in the place of the petitioner and others. The replacements have also been given. Since the petitioner has engaged in the illegal collection of money, this Court does not find any illegality in the termination of the petitioner. The petitioner has not made out any case for consideration of this Court.
