This Writ Petition is filed for a direction to the respondents to

sanction and release the family pension to the petitioner under the Family Pension Scheme under the Hindu Religious and Charitable Endowments Department in respect of her late husband namely, R.Vaidiyanathan , Archakar of Arulmigu Manavaleswarar temple with effect from the date of his death i.e., from 04.08.2023.

Upon hearing the learned Counsel for the petitioner and

perusing the material records of the case, it is the case of the petitioner that she is entitled for the family pension as per the scheme. She has already submitted an application and has also complied with the requirements such as annexing the legal heir certificate etc. Inspite thereof, the matter is kept

When the matter is taken up for hearing, the learned Additional Government Pleader (HR & CE) for the respondents would produce a written communication, dated 13.11.2025, whereby, the authorities are seeking for further details. It states that the application in the prescribed form should be annexed. Secondly, the pension payment order of the petitioner’s husband has to be annexed. As the third requirement, the petitioner is asked to go through the bank account of her late husband and find out if there is any excess payment and the petitioner was asked to enclose a Demand Draft for the excess amount. The fourth requirement is that the pensioner’s bank passbook should be annexed.

The third requirement is a gross abuse of power. The

petitioner is already an old lady, aged 77 years and she cannot be abused like this. Therefore, this requirement under Serial No.3 need not be complied with by the petitioner. Therefore, of the four requirements as stated supra , the petitioner shall once again comply with the three requirements even if she had already complied with. The petitioner shall enclose once more the application in the prescribed form, the pension payment order of her late husband and the passbook of her late husband along with a web-copy of this order and forward the same to the first 3/5

respondent within one week from the date of receipt of a web-copy of this order. Upon receipt of the same, the first respondent shall further process and the higher officials also duly sanction the family pension without further making the petitioner to run from pillar to post. The said exercise shall be completed within a period of 8 weeks from the date of submission of above documents by the petitioner.
