By consent of both parties, this writ petition is taken up for final disposal at the admission stage itself. Since no adverse order is passed against the private respondents, notice to them is dispensed with.

This petition has been filed challenging the order of the third respondent dated 25.03.2025.

It is the case of the petitioner that the petitioner underwent an Otoplasty Surgery on 29.02.2024 performed by the fourth respondent at the fifth respondent hospital, since, the petitioner experienced severe pain, blackening of ears, the petitioner claimed medical negligence and lodged complaint befoore the police authorities seeking criminal action and the same was forwarded to Medical Council which was dismissed by the Tamil Nadu Medical Council without furnishing relevant documents or affording adequate opportunity to the petitioner. Challenging the said order, the present writ petition has been filed.

The learned senior counsel for the petitioner submitted that already the petitioner has been filed a complaint before the District Consumer Disputes Redressal Commission, Chennai (South) in C.C.No.354 of 2024, hence, seeks to

work out the remedy before the Commission. Hence, seeks for a direction.

Heard the learned counsel for the petitioner, the learned Government Advocate (Crl.Side) and the learned Standing Counsel and perused the materials placed on record.

Considering the facts and circumstances of the case, this Court without going into the merits of the case directs the District Consumer Disputes Redressal Commission, Chennai (South) to dispose of the complaint filed by the petitioner in C.C.No.354 of 2024 independently without influence of the order of this Court and pass appropriate orders on merits and in accordance with law expeditiously as possible.
