Writ petition is filed under Article 226 of the Constitution of India seeking for issuance of a writ of certiorarified mandamus to call for the records relating to the Check slip dated 20.01.2026 issued by the Sub Registrar, Elavanasur, Kallakurichi District, the second respondent herein in refusing to register the deed of settlement dated 19.01.2026 executed by the petitioner herein and quash the same and consequently direct the second respondent herein to register the deed of settlement dated 19.01.2026 executed by the petitioner herein in favour of his son within such time.

After hearing the learned counsel for the petitioner for quite some time, this Court expressed its view that the appropriate remedy available to the petitioner is only before the civil court and that his grievance cannot be redressed through this writ petition. Following this observation, the learned counsel for the petitioner now seeks liberty for the petitioner to approach the civil court seeking for the relief as prayed for in this writ petition. He has also made an endorsement to that effect in the court bundle.

In view of the above, this writ petition is disposed of by granting liberty to the petitioner to approach the civil court. However, it is made clear that the civil court shall decide the matter uninfluenced by any of the observations made by the second respondent in the impugned order. No Costs. W.M.P.No.11797 of 2026 is closed.
