ORDER

This Miscellaneous Petition has been filed to permit the petitioners to withdraw the amount deposited in C.P.No.53 of 2019 on the file of the learned First Additional Labour Court, Chennai, pending disposal of the writ petition.

Heard Mr.A.Baskaran, learned counsel for the petitioners and

Mr.V.Govardhanam, learned counsel for the respondent.

This Court by an order dated 3/10/2025, granted interim stay on condition the Management deposits 1/3rd of the award amount granted by the learned I Additional Labour Court, City Civil Court Building, High Court Campus, Chennai in C.P.No.53 of 2019, within a period of eight weeks from the date of the said order.

The learned counsel appearing for the petitioners would submit that pursuant to the conditional order of stay, Management has deposited 1/3rd of the award amount of Rs.7,25,667/- on 18/11/2025 in the account of C.P.No.53 of 2019 on the file of the I Additional Labour Court, Chennai.

Keeping in view the long pending dispute and also elaborate reasons that were given by the labour Court and limitation of this Court while

entertaining the writ petition, petitioners are permitted to withdraw 1/3 of the award amount of Rs.7,25,667/- granted by the learned I Additional Labour Court, City Civil Court Building, High Court Campus, Chennai, in C.P.No.53 of 2019 and the remaining 2/3 of the award amount shall remain in deposit, subject to the outcome of the writ petition.
