Heard the learned counsel for the appellant, the learned Special Government Pleader for the respondents 1 and 2 and the learned counsel for the third respondent.

2.The unsuccessful writ petitioner is the appellant before us. The appellant and the third respondent are brothers. The third respondent had executed sale deed dated 30.09.2022 in favour of the respondents 4 and 5. It was presented for registration before the second respondent. The

document was registered. To cancel the same, the writ petitioner filed W.P.(MD)No.2811 of 2023. The learned Single Judge declined to grant any relief and the writ petitioner was relegated to go before the jurisdictional Civil Court. Challenging the said order, this writ appeal has been filed.

3.When once a document has been registered, the registering authority would lack the jurisdiction to cancel the same. It is only the Civil Court that can grant the relief sought for by the appellant. The learned Single Judge had not gone into the merits of the matter at all. We are therefore of the view that interference with the said order is not warranted. The writ appeal stands dismissed. No costs. Consequently, connected miscellaneous petition is closed.
