This transfer petition is filed to withdraw and transfer the case in O.S.No.26 of 2025, on the file of Family Court, Tirunelveli, Tirunelveli District to the file of Family Court, Tiruchirappalli, Tiruchirappalli District.

3. The marriage between Petitioner and Respondent was solemnized on 18.10.2023. Due to differences, parties have been separated. Thereafter, Respondent filed a petition in O.S. No.26 of 2025 on the file of Family Court, Tirunelveli, seeking for divorce and Petitioner filed a petition under the Protection of Women from Domestic Violence Act, 2005 in D.V.C. No. 148 of 2025 on the file of Additional Mahila Court, Tiruchirappalli.

4. This Court vide order dated 16.12.2025 referred the matter to mediation. Pursuant to the mediation, parties have amicably resolved all their disputes and differences. Petitioner and Respondent entered into a settlement agreement dated 11.02.2026 before the Mediation centre. As per the terms of the said agreement, parties have mutually agreed to dissolve their marriage dated 18.10.2023 and to close all pending proceedings between them. The terms of settlement agreement dated 11.02.2026 reads as follows:

Terms and conditions:-

i. In pursuance of the Settlement Agreement dated

11.02.2026, the respondent has paid a sum of Rs.7,00,000/-

¶27

(Rupees Seven Lakhs only) to the petitioner today, i.e., on 20.02.2026, by way of Demand Draft bearing No.007816 dated 13.02.2026 drawn on HDFC Bank, Velachery Branch. The

petitioner hereby acknowledges receipt of the said Demand Draft.

ii. The respondent has today handed over the petitioner's gold ornaments, namely:

a) Chain (Aram)

b) Necklace

along with all household articles and personal belongings of the

petitioner. The petitioner hereby acknowledges receipt of the same.

¶34

iii. The petitioner hereby declares and confirms that, except

for the household articles and dresses received today, there are no other household articles, dresses belonging to the petitioner remaining with the respondent.

iv. Both parties agree to maintain peaceful separation and

shall not interfere in each other's personal lives.

v. The petitioner hereby undertakes to appear before the jurisdictional Family Court and extend full cooperation for obtaining the decree of divorce.

vi. The petitioner and the respondent hereby agrees and undertakes that both the parties will comply with the remaining

terms of the earlier settlement agreement dated 11.02.2026, without any default.

vii. The parties have entered the above compromise on their own volition without any extraneous pressure or coercion and have appeared before this Hon'ble Court in person while recording the above joint compromise memo.

viii. In light of the compromise entered into between the parties, the petitioner is not pressing the present Transfer Civil Miscellaneous Petition in Tr.C.M.P. No. 441 of 2025.

ix. It is agreed between the parties that they shall appear before the Learned Family Court, Tirunelveli and the petitioner had no objection for decreeing the suit in O.S.No.26 of 2025 on the file of Learned Family Court, Tirunelveli.”

A joint compromise memo dated 20.02.2026 also filed by both parties

6. This transfer civil miscellaneous petition stands disposed of in terms of the joint compromise memo and Settlement Agreement. The joint compromise memo filed by the parties shall be treated as part and parcel of this order. No costs. Consequently, connected Miscellaneous Petitions are closed.
