The present Transfer Civil Miscellaneous Petition has been filed by the wife seeking withdrawal of H.M.O.P. No.177 of 2023 pending on the file of the Sub Court, Arakonam, Ranipet District, and to transfer the same to the file of the Family Court, Vellore.

The case of the petitioner, in brief, is that she is residing at Vellore and is dependent and constrained to travel to Arakonam for every hearing; that the transfer is sought on the ground of hardship and for effective participation in the proceedings; and that the petition for divorce has been instituted at Arakonam only to cause inconvenience to her.

This Court has considered the pleadings. In matrimonial matters, the paramount consideration while exercising power under Section 24 C.P.C. is to ensure a fair opportunity to both parties and to avoid undue hardship. The inconvenience of repeated travel, particularly to the wife, is a relevant factor. In the case on hand, the petitioner has shown sufficient cause regarding difficulty in attending the Court at Arakonam and the request for transfer is found to be bona fide.

Further, transfer of the proceedings to the Family Court, Vellore would advance the cause of justice and enable expeditious disposal, without causing prejudice to the respondent, who can always contest the matter before the transferee Court.

Accordingly, Tr.C.M.P. No.825 of 2025 is allowed. H.M.O.P. No.177 of 2023 on the file of the Sub Court, Arakonam, Ranipet District, is withdrawn and transferred to the file of the Family Court, Vellore. The Sub Court, Arakonam, shall transmit the entire records to the Family Court, Vellore, within three (3) weeks from the date of receipt of this order and the Family Court, Vellore shall dispose of the matter in accordance with law, as expeditiously as possible, uninfluenced by any observations made in this order. Interim stay granted by this Court on 07.08.2025 shall stand vacated and C.M.P. No.19011 of 2025 is closed. There shall be no order as to costs.
