The petitioner/wife seeks withdrawal of H.M.O.P.No.213 of 2025 pending on the file of the Family Court, Perambalur, and transfer of the same to the file of the Family Court, Villupuram.

The petitioner states that she is residing at Villupuram along with the minor child and that she is also pursuing a course there. She pleads that attending the case at Perambalur on every hearing date involves repeated travel, multiple changes of transport, and consequential strain, expense, and dislocation of the child’s routine and schooling.

Tr.C.M.P.No.1374 of 2025 4. On the facts pleaded, the petitioner has shown bona fide difficulty in repeatedly attending the Court at Perambalur, particularly having regard to her stated residence at Villupuram and the responsibility of caring for the minor child. Transfer to Villupuram would materially reduce such hardship and facilitate effective participation.

This Court, while considering transfer under Section 24 of C.P.C., is required to weigh the ends of justice and the comparative convenience of parties. In matrimonial proceedings, the convenience of the wife is a relevant consideration, particularly when she pleads difficulty in travelling to the Court where proceedings are instituted.

In the result, Tr.C.M.P.No.1374 of 2025 is allowed. H.M.O.P.No.213 of 2025 pending on the file of the Family Court, Perambalur is withdrawn and transferred to the file of the Family Court, Villupuram, for disposal in accordance with law. The Family Court, Perambalur shall transmit the entire records to the Family Court, Villupuram forthwith. The transferee Court shall take the matter on file on
