The Second Appeal is directed against the judgment and decree passed in A.S.No.13 of 2010 dated 10.01.2012 on the file of the Subordinate Court, Pudukkottai, partly allowing the judgment and decree passed in O.S.No.134 of 2007 dated 30.10.2009 on the file of the District Munsif cum Judicial Magistrate, Thirumayam.

It is evident from the records that since batta for the respondents 1, 2 and 4 was not paid despite getting sufficient time, the second appeal
