Madras High Court (T.V.Thamilselvi, J.) allowed a second appeal under Section 100 of the Code of Civil Procedure by the plaintiff Senthilnathan against the judgment and decree dated 08.07.2024 of the XIX Additional City Civil Court, Chennai in A.S.No.88 of 2022, whereby the first appellate court allowed the appeal and reversed the decree and judgment dated 25.08.2022 of the XV Assistant City Civil Court, Chennai in O.S.No.3879 of 2019, declining the relief of declaration while confirming the other reliefs. The suit sought a mandatory injunction directing the defendant (the plaintiff's brother, Karunakaran) to vacate the B-scheduled property measuring 945 square feet on the first floor at New No.147, Old No.52, Old Mambalam Street, Saidapet, Chennai 600 015. The plaintiff's title rested on Ex.A-1, a settlement deed dated 10-09-2009 executed by his mother Sarojammal, who had executed three settlement deeds on 10.09.2009 in favour of her three children (Kalavathi, Malarvizhi and Senthilnathan); the respondent's objections, pursued after WP.No.6621 of 2013 via the District Revenue Officer, were dismissed as illegal. During the pendency of the second appeal the decree was executed through EP.No.5103 of 2022: the possession warrant dated 02-04-2024 was executed through the Court Amin with police assistance, and the respondent vacated and signed the delivery warrant before two witnesses. Held, allowing the appeal: the settlement deed dated 10-09-2009 stands valid; the first appellate judge failed to appreciate that, despite nearly ten years, the settlement deed had not been cancelled, and erroneously reversed the relief; the findings of the first appellate Judge are set aside; the execution of the decree through EP is recorded; the connected CMP.No.19462 of 2024 is closed; no order as to costs. Precedents placed on record by counsel (AIR 1978 Calcutta 559, quoting AIR 1932 PC 92, Kadiyala Venkata Subamma v. Ramayya, on an executor's title under the Indian Succession Act) were referred to but not adopted as the basis of this Court's decision.
