According to the petitioner, he is the younger son and the 1^st

respondent is his mother and respondents 2 to 4 are his elder sisters. The father of the petitioner namely Mr. Narasimhan died intestate on 11.03.2013. The deceased Mr. Narasimhan, during his lifetime, had purchased shares in his name from E.I.D. Parray (India) Limited and Coromandel Fertilizers Limited, now known as Coromandel International Limited. In spite of due and diligent search has been made, no Will has been found executed by the father of the petitioner. The petitioner and the respondents are Class-I legal heirs of the deceased Mr. Narasimhan. The parents of the deceased Mr. Narasimhan, predeceased him. The value of the said assets is approximately at Rs.24,86,020. The petitioner, as the only son of the deceased, claims to be entitled to the estate. The respondents have filed their consent affidavits to issue Succession Certificate in favour of the petitioner. There is no other next of kin other than the parties herein. Therefore, the petitioner has filed this petition to grant succession certificate in his favour.

After filing of this Original Petition, the petitioner was directed to effect paper publication and the same was also effected. No any objection was received from any party. Thereafter, the matter was posted for examination of witnesses and the evidence was recorded. On the side of the petitioner, he examined PW1 and marked Ex.P.1 to Ex.P8.

The petitioner herein has been examined as PW1 and Ex.P.1 to Ex.P.8 were marked. On a careful perusal of the evidence of PW1 and the documents Ex.P.1

to Ex.P8, they reveal that the petitioner is the legal heir of the deceased Mr. Narasimhan and the deceased had purchased some shares mentioned in the Schedule of the petition and he died intestate, thereby, his legal heir is entitled to get those shares of the deceased and therefore, petitioner is entitled to the Succession Certificate. The respondents have also consented to issue succession certificate in favour of the petitioner.

In view of the same, this Original Petition is allowed. The petitioner is entitled to the value of the assets and a direction for grant of Succession Certificate in favour of the petitioner with power to collect the securities and to receive the interest and dividends on and negotiate and transfer the securities specified in the Schedule, as applicable till the date of withdrawal, is issued.
