The petitioner, who is the husband of the detenue, has filed this Habeas Corpus Petition for a direction to respondents 1 to 3 to produce the body or person of his wife and to set her at liberty.

The case of the petitioner is that he married the detenue on 04.12.2025. Since it was an inter-caste marriage, the parents of the detenue were opposed to the said marriage. On 23.02.2026, after the petitioner had left for his work and returned home, he found that the detenue was missing. Hence, he approached the 3^rd respondent and lodged a complaint. Since no effective steps were taken to find the whereabouts of the detenue, the present Habeas Corpus Petition was filed before this Court.

When the matter was taken up for hearing today, the detenue was produced before this Court. She stated that her date of birth is 11.05.2003

and that she is studying B.Com, and even though she married the petitioner, the detenue specifically stated that she is not inclined to go along with the petitioner and that she wants to stay with her parents.

In the light of the above statement made by the detenue, we cannot force the detenue to go along with the petitioner. If the petitioner is aggrieved by the same, it is left open to the petitioner to work out his remedy in the manner known to law before the appropriate Court.
