One Srinivasan, husband of Suganya (detenue) has filed this habeas

corpus petition directing the second respondent to produce her.

¶28

A perusal of the affidavit reveals that he had reasons to suspect

¶29

that the detenue was having a relationship with R3. The petitioner had filed a complaint before the Inspector of Police, Arani Taluk, Tiruvannamalai District and a case in Crime No. 175 of 2026 had been registered under the head ‘woman missing’. The present petition has been instituted since police had not reported any progress in securing the detenue.

Today when the matter is called, the detenue is produced in

Court by the authorities. Mr.Mohamed Riyaz, shows us a copy of the Aadhar card of detenue wherein her date of birth is mentioned as

06.06.1992 making her 34 years of age as on date. Incidentally, the affidavit filed in this petition stated that the detenue is 41 years.

We have interacted with the detenue, who states that she does

not want to return to her matrimonial home on account of differences and domestic violence from her husband. In light of her age and the fact that the detenue is categoric that she has not been illegally detained against her will and has voluntarily left the matrimonial home, there is nothing

further to be adjudicated in this petition.
