Civil Suit filed under Order VII Rule 1 of Code of Civil Procedure, 1908, and Order IV Rule 1 of the Original Side Rules, prays for a judgment and decree against the defendants;

(a) To pass a preliminary decree of partition and allotting 4/5^th share to the 1^st to 4^th plaintiffs in respect of the schedule mentioned property which is more fully described in the schedule hereunder and to pass a final decree by appointing an Advocate Commissioner to divide the 4/5^th share to the respective plaintiffs by metes and bounds and to allocate the same and put the plaintiffs in possession of their share; and

(b) To pay the costs of the suit.

JUDGMENT

This Civil Suit has been filed by the plaintiffs seeking partition by allotment of 4/5^th share to the plaintiffs 1 to 4 in respect of the suit schedule property and for costs.

On 24.03.2025, this Court took on record the written statement filed by the defendant and referred the matter to the Tamil Nadu Mediation and Conciliation Centre attached to the High Court of Madras. The parties have entered into a Settlement Agreement dated 28.01.2026, and the same has been filed before this Court along with the Mediation report.

Heard the learned counsel appearing on both sides and perused the

records, including the Mediation report.

This Court has perused the terms of Settlement Agreement, which

has been signed by the respective parties, and finds no legal impediment in recording the same.

Accordingly, the said Settlement Agreement is recorded and shall

form part of the decree. The suit is decreed in terms of the Settlement Agreement. No order as to costs.

The Registry is directed to refund the Court fee to the plaintiffs as

per the Rules in force.
