The revision petitioner/husband filed an application seeking temporary custody of the minor child, P. Akil Dev, aged about 6 years. The revision petitioner is presently residing in Chennai and is employed in the IT sector. The trial Court, taking into consideration the age of the child, permitted the revision petitioner to visit his minor son on every first Saturday of each month from 10.00 a.m. to 12.00 p.m. at the office of the District Legal Services Authority, Kanniyakumari at Nagercoil, in the presence of duty staff. Aggrieved by the said order, the present Civil Revision Petition has been filed.

The learned counsel for the respondent submitted that the child is of tender age, being only six years old.

The learned counsel for the revision petitioner submitted that

the child may not exhibit natural behaviour in the presence of duty staff and may feel uncomfortable in the formal atmosphere of the District Legal Services Authority. It was further submitted that a relative of the revision petitioner is residing at Nagercoil, and the child may be produced at the said residence instead of the District Legal Services Authority.

Considering the grievance expressed by the learned counsel for

the revision petitioner, the revision petitioner is directed to file an application before the trial Court seeking modification of the visitation arrangement by furnishing the address of his relative, who is a permanent resident of Nagercoil. On such application being made, the learned trial Judge shall consider the same and pass appropriate orders, as expeditiously as possible, directing the respondent/wife to produce the child on every first Saturday of the month from 10.00 a.m. to 12.00 p.m. at the said address.
