ORDER

This Civil Revision Petition has been filed seeking modification of the order dated 30.10.2024 passed by the III Additional Principal Family Court, Chennai, in H.M.O.P. No. 1527 of 2024, insofar as it relates to the visitation rights granted to the respondent. The petitioner seeks permission to take the minor child abroad and reside with the child as the sole custodian for the purposes of education and upbringing, and further seeks authorization to apply for and obtain a passport, visa, and all other travel-related documents for the minor child without requiring the respondent's further consent.

The learned counsel for the petitioner submits that while disposing of H.M.O.P. No. 1527 of 2024, the Trial Court granted a decree of divorce by mutual consent and also granted visitation rights to the respondent, permitting him to meet the minor child every week at a public place upon prior intimation. The said order was passed on 30.10.2024. It is further submitted that the petitioner now intends to move abroad for higher studies and that the visitation arrangement imposed by the Trial Court is causing practical difficulties in obtaining a visa and completing other related formalities.

The respondent, Mr. Muthukumar, appeared before this Court in person and submitted that he is an MBA graduate. Considering the welfare and future prospects of the minor child, he stated that he has no objection to the deletion of

the visitation rights granted by the Trial Court and has given his consent unconditionally. The said submission of the respondent is recorded.

In view of the above, the visitation rights granted to the respondent by the Trial Court under the order dated 30.10.2024 are deleted.

Accordingly, this Civil Revision Petition is allowed. The petitioner is permitted to take the minor child abroad and reside with the child as the sole custodian for the purpose of education and upbringing. The petitioner is also authorized to apply for and obtain a passport, visa, and all other travel-related documents for the minor child without requiring any further consent from the respondent. However, father is permitted to talk with her daughter through phone as and when he requires.There shall be no order as to costs. Consequently, the connected miscellaneous petition, if any, is closed.
