ORDER

The Revision Petitioner herein is the 2^nd Judgment Debtor in the execution proceedings initiated in E.P.No. 124 of 2023 on the file of learned III Additional District and Sessions Court, Villupuram at Kallakurichi, which was filed by the 1^st respondent/decree holder for the execution of award passed in ARC No.94 of 2021.

Since the relief claimed by the Revision Petitioner only seeking a direction for a speedy disposal, the notice to the respondents is dispensed with.

The learned counsel for Revision Petitioner would submit that the 1^st respondent initiated execution proceedings in the year of 2023 and subsequently, the application in E.A.No.24 of 2024 and E.A.No.23 of 2024 was filed by legal heirs of petitioner to stay the execution proceedings and to make 2/3rd of partition in petitioner’s attached property. He would submit that since the pleadings in the said application also completed, there is no legal impediment for the Executing Court to conduct enquiry and dispose of the matter. However, the matter is being adjourned without effective progress. Therefore, he wanted to direct the Executing Court to dispose the application as early as possible.

Considering the facts and circumstances and also the fact that the Execution Applications are pending from the year of 2024 and so far there is no effective progress in the execution proceedings, this Court is inclined to direct

the Executing Court to dispose the Execution Petition filed in E.P.No. 124 of 2023 in ARC No.94 of 2021 as early as possible within a period of twelve weeks from the date of receipt of copy of this order. Accordingly, this Civil Revision Petition is disposed of. No costs.
