The present criminal petition is filed challenging the impugned order dated 03.01.2026 passed in Crl.M.P. No. 01 of 2026 on the file of the Principal Sessions Judge, Madurai and to modify the bail condition insofar as it relates to the production of a solvency certificate.

The brief facts of the case are that on 20.05.2005, petitioner allegedly attempted to rob de-facto complainant by threatening him with a deadly weapon near the Court entrance. Subsequently, an FIR was registered in Crime No.1134 of 2005 for the alleged offences punishable under Sections 392 r/w 397 of IPC. On completion of the investigation, a charge sheet was filed in P.R.C.No.79 of 2006 before Judicial Magistrate No.VI, Madurai. However, petitioner had not appeared before Trial Court regularly and therefore, a Non-Bailable Warrant came to be issued against him. Consequently, he was arrested and remanded to judicial custody. Thereafter, petitioner filed Crl.M.P.No.5694 of 2025, before Principal Sessions Judge, Madurai seeking bail and Principal Sessions Judge, Madurai vide order dated 04.12.2025 granted bail to petitioner subject to following conditions:-

“ In the result, the petitioner is ordered to be enlarged on bail on his

executing a bond for Rs. 10,000/- along with two sureties (with Solvency Certificate) for a like sum each to the satisfaction of Judicial Magistrate No. VI, Madurai subject to the following conditions:-

i. After release, the petitioner shall appear before the Judicial Magistrate No. VI, Madurai weekly once i.e. on every Monday at 10.30 a.m. till the case is committed.

ii. The petitioner shall co-operate for the quick committal of the case and he shall not threaten the witnesses.

iii. That the petitioner shall not commit an offence similar to the offence of which he is accused, or of the commission of which he is suspected and

iv. If there is any violation of condition, the Investigation Officer is within his discretion to approach the Court of the learned Judicial Magistrate, concerned for cancellation of bail as per the ruling of the Hon'ble Supreme Court reported in PK.Shaji/Vs/State of Kerala, (2005) AIR S.C.W.5560 .”

Thereafter, petitioner filed Crl.M.P.No.01 of 2026 before Principal Sessions Judge, Madurai, seeking modification of condition relating to production of solvency certificate, in Crl.M.P.No.5694 of 2025 dated 04.12.2025. However, the same was dismissed by Principal Sessions Judge, Madurai vide order dated 03.01.2026. Aggrieved, petitioner has filed present criminal revision petition.

Learned counsel for petitioner would submit that present revision petition has been filed on the limited ground that the condition relating to the production of solvency certificate is onerous, inasmuch as solvency certificate can be issued only by Bank officials, Financial institutions or by Revenue Authorities. Therefore, he would submit that petitioner may be permitted to furnish two sureties without solvency certificate.

Learned Government Advocate (Crl.Side) for respondent would submit

that he has no serious objection to the above request made by petitioner. However, he would submit that petitioner must undertake to cooperate with the proceedings, including the committal proceedings and Trial thereafter, without seeking unnecessary adjournments. He would further submit that petitioner must ensure his presence before the Trial Court on all hearing dates.

In view thereof, the Judicial Magistrate No.VI, Madurai, shall not insist

for production of solvency certificate. Accordingly, condition imposed by Principal Sessions Judge, Madurai for grant of bail in Crl.M.P.No.5694 of 2025 dated 04.12.2025 stands modified as follows:-

“Petitioner shall execute a bond for Rs.10,000/- along with two sureties for a like sum each to the satisfaction of Judicial Magistrate No.VI, Madurai.”

All other conditions in the order dated 04.12.2025 shall remain unaltered.
