O R D E R

The revision challenges the order dated 29.10.2025 passed in C.M.P. No. 599 of 2025 by the learned Judicial Magistrate, Sulur, Coimbatore, refusing to direct registration of FIR on the basis of the petitioner’s complaint dated 02.06.2025.

The gist of the petitioner’s complaint is that the proposed accused, on 17.05.2025 at about 23.45 hours, had trespassed into the property of the petitioner, assaulted him, pushed his mother and kicked his father. The petitioner’s complaint was not taken cognizance by the Police and hence, the petitioner had filed C.M.P. No. 599 of 2025 under Section 175(3) of BNSS seeking registration of FIR.

The learned Magistrate, by the order under challenge, dismissed

the said application on the ground that the petitioner had not filed any medical records to prove the alleged assault on him and his parents. The

learned Magistrate further observed that the mandatory provisions under Section 173(1) and 173(4) of BNSS have not been complied with by the petitioner.

Heard the learned counsel for the petitioner.

It is seen from the records that the petitioner has not

produced any proof for having lodged the complaint to the jurisdictional Police. The petitioner has also not exhausted his remedy to send the complaint in writing to the Superintendent of Police concerned as provided under Sections 173(1) and 173(4) of BNSS. Therefore, this Court finds no infirmity in the order passed by the learned Magistrate and the revision stands dismissed.
