2.The case of the prosecution is that the petitioner and other

accused received money from the defacto complainant for getting job for her. Thereafter, they neither secured a job nor returned the money to the defacto complainant. Hence, the complaint.

3.The learned counsel for the petitioner submitted that the petitioner has already repaid a sum of Rs.2,00,000/- to the defacto complainant and he is ready and willing to pay the balance amount of Rs.4,00,000/-. He further submitted that the petitioner is ready to abide by any stringent conditions which may be imposed by this Court. Hence, he seeks anticipatory bail

4.The learned Government Advocate (Criminal Side) appearing for the respondent submitted that the petitioner and other accused had cheated the defacto complainant to secure a job and only repaid a sum of Rs.2,00,000/- to the defacto complainant and the remaining amount is yet to be paid. Hence, he opposed for grant of anticipatory bail to the petitioner.

Taking into consideration of the facts and circumstances of the

case and also the fact that the petitioner is ready and willing to pay the balance amount, this Court is inclined to grant anticipatory bail to the petitioner, with certain conditions.

Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance, within a period of fifteen days from the date on which the order copy made ready, before the learned Judicial Magistrate No.II, Virudhunagar, on condition that the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the respondent police or the police officer who intends to arrest or to the satisfaction of the learned Judicial Magistrate No.II, Virudhunagar, failing which, the petition for anticipatory bail shall stand dismissed and on further condition that:

(a) the petitioner and the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity;

(b) the petitioner is directed to pay a sum of Rs.

4,00,000/-(Rupees four lakhs only) in five equal monthly installments to the defacto complainant. The first installment of Rs.80,000/- shall be paid on or before 20.02.2026; the second installment of Rs.80,000/- on or before 20.03.2026; the third installment of Rs.80,000/- on or before 20.04.2026; the fourth installment of Rs.80,000/- on or before 20.05.2026 and the fifth installment of Rs.80,000/- on or before 20.06.2026. In the event of any default in payment, the defacto complainant shall be at liberty to approach this Court.

(c) the petitioner shall report before the respondent police daily at 10.30 a.m., until further orders;

(d) the petitioner shall not tamper with evidence or witness either during investigation or trial;

(e) the petitioner shall not abscond either during investigation or trial;

(f) on breach of any of the aforesaid conditions, the learned Magistrate/ Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji Vs. State of Kerala [(2005) AIR SCW 5560] and;

(g) if the accused/petitioner thereafter abscond, a fresh
