This criminal original petition has been filed seeking to quash the proceedings in S.T.C.No.1139 of 2025, pending on the file of the Judicial Magistrate Court No.I, Ramanathapuram, as against the petitioner .

2. The case of the prosecution is that on 04.04.2024, the petitioner, who contested as a candidate in the Parliamentary Constituency election in Ramanathapuram, along with the members of his alliance party, acted in violation of the election rules, by assembling and conducting an election campaign and by bursting crackers after 10.00 p.m., thereby, endangering human life and safety of the surrounding public. Consequently, a case in Crime No.50 of 2024 was registered by the 1 st respondent police for the offences under Sections 143 & 286 IPC. After completion of investigation, the final report was filed before the learned Judicial Magistrate No.I, Ramanathapuram and the learned Magistrate took cognizance of the same and the case was taken on file in S.T.C.No.1139 of 2025, which is now sought to be quashed.

Learned counsel for the petitioner submitted that the facts of the

instant case are similar to the facts of the cases in Jeevanandham and

others vs. The Inspector of Police, Velayuthampalayam Police Station, Karur District reported in ( 2018 2 LW (Crl) 606) and Sri Raja vs Inspector of Police, Sivakasi Town Police Station Virudhunagar District and others (Crl.O.P(MD) No.7922 of 2019, decided on 30.08.2019), in which the proceedings were quashed. Hence, he prayed to quash the proceedings pending against the petitioner.

4. Learned Additional Public Prosecutor appearing for the 1^st respondent police, on instructions from Mr.N.Muthu Irulappan Suresh, Spl. Sub-Inspector of Police, Keelakarai Police Station, Ramanathapuram District, submitted that based on the complaint given by the 2 nd respondent, DC-211, FST Team – A, the aforesaid case came to be registered on 04.04.2024. He further concurred with the above submission of the learned counsel for the petitioner that the facts of the instant case are akin to those in the aforementioned two cases .

Heard the learned counsel appearing on either side and perused the materials available on record.

In view of the above, this Court is of the opinion that the above

said two decisions would apply on all fours to the present case and that no useful purpose will be served by keeping the impugned proceedings pending and the same is liable to be quashed.

Accordingly, this criminal original petition stands allowed and the impugned proceedings pending against the petitioner in S.T.C.No.1139 of 2025, on the file of the Judicial Magistrate Court No.I, Ramanathapuram , is hereby quashed. Consequently, the connected miscellaneous petitions are closed.
