ORDER : The Court made the following order :-

The petitioner/Accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 191(2), 308(4), 333, 115(2), 118(1), 133, 127(2), 140(1), 351(3), in Crime No. 695 of 2025 on the file of the respondent police, seeks anticipatory bail.

The case of the prosecution is that the petitioner along with

other accused persons abducted the defacto complainant for non-payment of the borrowed money. Hence, the present case.

The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He further submitted that the petitioner is willing to abide by any conditions that may be imposed by this Court. Hence, he seeks anticipatory bail for the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent police submitted that the specific allegation against the petitioner is that he abducted the defacto complainant from his house and also assaulted him. He further submitted that co-accused in this case has already been granted anticipatory bail. However, he vehemently opposed to grant anticipatory bail to the petitioner.

Considering the facts and circumstances of the case and also the

¶24

fact that the co-accused has already been granted anticipatory bail, this Court is inclined to grant anticipatory, subject to certain conditions.

6.Accordingly, this Petition is allowed and the petitioner is ordered

¶26

to be released on bail in the event of arrest or on his appearance, on condition that the petitioner shall execute a bond for a sum of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties, each for a like sum to the satisfaction of the Additional Mahila Court (Judicial Magistrate Level), Theni, within a period of fifteen days from the date of receipt of a copy of this order and on further conditions that:

[a]the petitioner and the sureties shall affix their

photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhaar card or bank pass book to ensure their identity;

¶29

[b] the petitioner shall stay at Tirunelveli and shall

¶30

report before the Inspector of Police, Tirunelveli Town Police Station, Tirunelveli daily at 10.30 a.m., until further orders.

[c]the petitioner shall not tamper with the evidence

¶35

or witness either during investigation or trial.

¶36

[d]the petitioner shall not abscond either during investigation or trial.

¶37

[e]On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner is released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].

[f] If the accused thereafter absconds, a fresh FIR

can be registered under Section 269 of BNS.
