ORDER : The Court made the following order :-

The petitioner / Sole Accused, who was arrested and remanded to judicial custody on 08.06.2026, for the offences punishable under Section 123 of BNS, 2023 and Sections 6(b) and 24(1) of Cigarettes and Other Tobacco Products Act, 2003, in Crime No.203 of 2026 on the file of the respondent police, seeks bail.

The case of the prosecution is that the petitioner was found in possession of 165 packets of banned tobacco products in three white sacks, weighing about 37.125 kgs in the car belongs to him. Hence, the case.

The learned counsel appearing for the petitioner would submit that the petitioner is innocent, he was falsely implicated in this case and he has not committed any offence as alleged by the prosecution. He

would further submit that the petitioner is in custody from 08.06.2026 and ready to abide any condition imposed by this Court. Hence, he prayed bail for the petitioner.

The learned Counsel for the State of TN (Crl. Side) appearing for the State reiterated the prosecution case and reported that the petitioner has seven previous cases, out of which five cases are similar in nature and the quantity involved in this case is a high quantity namely 37.125 kgs. Investigation is still pending. He opposed the grant of bail to the petitioner.

This Court heard both sides and perused the materials available on record.

Considering the facts and circumstances of the case and also considering the fact that the petitioner has seven previous cases, out of which, five cases are similar in nature and a huge quantity of tobacco products were recovered and therefore, there are no grounds to grant bail to the petitioner. Hence, I am not inclined to grant bail to the petitioner
