The present Criminal Original Petition has been filed by A1 and A2 in C.C.No.2313 of 2025, on the file of the Judicial Magistrate No.V, Madurai, seeking to quash the charge sheet wherein, they are charged with the offences under Sections 419, 468 and 471 of IPC.

A perusal of the records reveal that the petitioners herein are accused in another case and in compliance with the bail order granted by the Court they were directed to appear before the second respondent police station regularly. The allegation in the charge sheet is that A1 impersonated A2 and signed the register in the respondent police station, as if A2 was present.

3. According to the learned counsel appearing for the petitioners, in fact, A2 was also present in the police station on all the days and after four days false complaint case has been lodged.

4. Heard the learned counsel appearing for the petitioners and perused the materials available on record.

Whether the second petitioner herein was present before the police station on all the days and whether he had signed the register or not, is the subject matter of trial and the same cannot be considered in the quash petition. However, the personal appearance of the petitioners herein shall be dispensed with by the trial Court unless specifically directed to appear before the trial Court.

6. In view of the above said facts, there are no merits in this petition.

Accordingly, this Criminal Original Petition is dismissed. Consequently, connected Miscellaneous Petitions are closed.
