PRAYER :- This Petition is filed under Section 528 BNSS, to call for the records pertaining to the impugned order passed in Crl.R.C.No.45 of 2024 dated 17.04.2025 passed by the learned VI Additional Sessions Judge, Madurai, and the order passed in Crl.M.P.No.4185 of 2024 dated 26.09.2024 by the learned Judicial Magistrate No.1, Madurai and set aside the same.

Seeking to quash the impugned order passed in Crl.R.C.No.45 of 2024 dated 17.04.2025 passed by the learned VI Additional Sessions Judge, Madurai, and the order passed in Crl.M.P.No.4185 of 2024 dated 26.09.2024 by the learned Judicial Magistrate No.1, Madurai, this Criminal Original Petition is filed.

of the learned VI Additional Sessions Judge, Madurai. The first respondent herein is the petitioner in Crl.M.P.No.4185 of 2024 in R.P.R.No.927 of 2024 on the file of the learned Judicial Magistrate No.1, Madurai, wherein he filed a petition seeking a direction to the petitioner herein to return a sum of Rs.10,00,000/- which was transferred from his account maintained in the petitioner bank. In the meantime, a complaint was lodged by the first respondent before the second respondent police. Pending the said complaint, the learned Judicial Magistrate No.1, Madurai, in Crl.M.P.No.4185 of 2024 in R.P.R.No.927 of 2024, partly allowed the petition by directing the petitioner's bank to transfer the said amount to the account of the learned Judicial Magistrate No.1, Madurai. Aggrieved by the same, the first respondent preferred Crl.R.C.No.45 of 2024 before the learned VI Additional Sessions Judge, Madurai. The learned Sessions Judge, by order dated 17.04.2025, allowed the same by setting aside the order dated 26.09.2024 passed in Crl.M.P.No.4185 of 2024 in R.P.R.No.927 of 2024 by the learned Judicial Magistrate No.1, Madurai, and thereafter directed the petitioner bank to return the amount of Rs.10,90,047.20/- to the account of the first respondent/ defacto complainant by crediting the same to his account No.30452536566 at

PBB Madurai, Branch Code No.4331, within 15 days from the date of the said order. Challenging the same, the petitioner/bank is before this Court seeking to set aside the order dated 17.04.2025 passed in Crl.R.C.No.45 of 2024 by the learned VI Additional Sessions Judge, Madurai.

3.The learned Additional Public Prosecutor appearing for the second respondent Police submitted that a case in Crime No.78 of 2025 has been registered against the fourth respondent for the offences under Section 420 of IPC and Section 66 D of Information Technology Act.

4.When the matter came up for hearing on 24.07.2025, this Court suo motu impleaded the third and fourth respondents and also granted an interim stay.

5.In the interregnum, the learned counsel appearing for the petitioner submitted that the petitioner bank had communicated with the third respondent bank, in which the third respondent had readily agreed to transfer the amount back to the account of the first respondent maintained with the petitioner bank.

6.In view of the same, the third respondent bank is hereby directed

to transfer the amount of Rs.10,00,000/- to the account of the first respondent/defacto complainant's account No.30452536566 in the PBB Madurai, Branch Code No.4331 within a period of two weeks from the date of receipt of a copy of this order.

7.With the above direction, this Criminal Original Petition stands disposed of. Consequently, the connected Criminal Miscellaneous Petition is closed.
