Sections 288, 125(b), 106(1) of BNS Act, 2023, and Section 5 of the Explosives Substances Act, 1908, in Crime No.204 of 2026, on the file of the respondent police seek anticipatory bail.

The allegation against the petitioners is that the petitioners, who are arrayed as A3 and A4, joined hands with A1 and A2 involved in illegal manufacturing of fuses used for crackers. Huge quantities of raw materials were stored, and manufacturing activities were carried out at two places. In one place, an explosion occurred on 10.06.2020, resulting in the death of four migrant workers. Hence, the case has been registered.

The learned counsel for the petitioners submitted that the petitioners are innocent and they have not committed any such offence as alleged by the prosecution and they have been falsely implicated in this case. He further submitted that the petitioners herein are only the owner of the premises and A1 was already granted anticipatory bail and the petitioners are ready to co-operate with the investigation. Hence, he prayed to grant anticipatory bail to the petitioners.

The learned Counsel For State of TN (Crl.Side) appearing for the respondent police reiterated the prosecution case and on instructions,

submitted that the present petitioners were actively involved in running the manufacturing units and had set up the illegal units, which resulted in the death of four persons and the investigation is at preliminary stage.

Hence, he opposed to grant anticipatory bail to the petitioners.

I have gone through the FIR and also the connected materials.

6.Considering the nature of allegations against the petitioners, and

also considering the fact that the petitioners are the main accused and they were actively involved in illegal manufacturing activities which resulted in the death of four migrant workers, this Court is not inclined to grant anticipatory bail to the petitioners.
