The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 191(1), 191(2), 126(2), 296(b), 118(1), 351(3) of BNS, r/w Section 3(1) of PPDL ACT, in Crime No.18 of 2026 on the file of the respondent police, seek anticipatory bail.

The case of the prosecution is that since

the 1^st petitioner's father need money for purchasing land the petitioners' borrowed jewel from the defacto complainant and the same was not returned. Hence, the defacto complainant and her family members went to the petitioner's house and asked the return of jewels. At the time, a wordy quarrel arose between them and the petitioners attacked the defacto

complainant and her family members and they sustained injuries. Hence, the complaint.

The learned counsel for the petitioners submitted that the petitioners are innocent persons

and they have not committed any offences as alleged

by the prosecution. He further submitted that the petitioners are ready and willing to abide by any conditions which may be imposed by this Court. Hence, he seeks anticipatory bail to the petitioners.

The learned Government Advocate (Criminal

Side) submitted that the injured has been discharged from the hospital. However, he opposed for grant of anticipatory bail to the petitioners.

Considering the facts and circumstances of

the case, and also considering the fact that the

¶36

injured has been discharged from the hospital, the interim anticipatory bail already granted is made absolute and this Court is inclined to grant anticipatory bail to the petitioners with certain conditions.

Accordingly, this Petition is allowed and the

petitioners are ordered to be released on bail in the event of arrest or their appearance, within a period

of fifteen days from the date of receipt of a copy of

this order, before the learned Judicial Magistrate No.II, Madurai, on condition that the petitioner shall execute a bond for a sum of Rs.10,000/(Rupees Ten Thousand only) with two sureties each, each for a like sum to the satisfaction of the respondent Police or to the Police Officer, who intends to arrest or to the satisfaction of the learned Magistrate concerned and on further conditions that:

(a) the petitioners and the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity;

(b) the petitioners are directed to deposit a sum of Rs.50,000/- (Rupees Fifty Thousand only), to the credit of Crime No.18 of 2026 before the learned Judicial Magistrate No.II, Madurai. After receipt of entire amount, the learned Judicial Magistrate, shall deposit the said amount in

an interest bearing Fixed Deposit in any Nationalized Bank initially for a period of one year and renew them periodically until the final order/Judgment is passed in the case in Crime No.18 of 2026. The learned Judicial Magistrate or Trial Court shall pass orders regarding entitlement of the said amount in its final order/Judgment;

(c) the petitioners shall report before the respondent police daily at 10.30 a.m for a period of one week and thereafter, as and when required for interrogation;

(d) the petitioners shall not tamper with evidence or witness either during investigation or trial;

¶52

(e) the petitioners shall not abscond either during investigation or trial;

¶53

(f) on breach of any of the aforesaid conditions, the learned Magistrate/ Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioners released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in
